Capital punishment is currently authorized in 31 states by the federal government and the United States military. In recent years, New Mexico (2009), Illinois (2011), Connecticut (2012), and Maryland (2013) have legislatively abolished the death penalty, replacing it with a sentence of life imprisonment with no possibility for parole. The Nebraska legislature also abolished capital punishment in 2015, but it was reinstated by a statewide vote in 2016. Additionally, courts in Delaware recently ruled that the state’s capital punishment law is unconstitutional. States across the country will continue to debate its fairness, reliability, and cost of implementation.

The death penalty has been a part of the U.S. justice system since the birth of this Nation. It has been debated off and on throughout the history of the United States. Proponents of capital punishment say that it deters murders, while people against capital punishment say there is no deterrent effect. There are other reasons for and against cited by those on both sides of the issue, including: cost, innocence, and immorality.

After reviewing the readings on the background page, write a 4- to 5-page paper in which you define the death penalty as it is applied in the United States, and then answer the following questions:
1. Based on the required readings, is the death penalty fair? Support your position.
2. After reviewing “Fact Sheet” from Death Penalty Information Center, what significant statistics can you pull out (e.g., race, sex, location)?

Capital punishment

The use of capital punishment has long been a contentious issue in America. While there seems to be little evidence that the death penalty acts as a deterrent, proponents argue that deterrence is not the only function of punishment. Proponents believe that certain crimes simply deserve the harshest punishment, regardless of its potential for deterrence.

Prepare a PowerPoint presentation of 8-10 slides that addresses the following points about capital punishment. Your slides should be clear and concise, with supporting elaboration in the “notes” area.

What does it typically cost to execute someone? Why does it take so long and cost so much?
Based on recent statistical data and findings, how often are innocent people given the death sentence and/or executed? How is it determined that a condemned convict was actually innocent?
Should everyone be a candidate for capital punishment or should some people be exempt based on their position in society? Are there any other factors that should be considered in exempting people from or applying the death penalty?
Analyze recent Supreme Court cases regarding capital punishment (from 2000 to present) and offer a reasoned prediction regarding the future use of capital punishment in the United States.

Capital punishment is legal in the state of Texas. Since 1982, Texas has executed 578 people, with the most recent executions occurring this year (TCADP, 2022). In 2022 Texas executed 5 individuals. In the earlier years before 2004, the law permitted the execution of juveniles. However, with more controversies surrounding the execution of minors, the death penalty was revised only to affect adults – People aged 18 years and older (Holler, 2018). The impact of the death penalty on the affected parties has yet to be exhaustively researched. These include the immediate family members of the victims and other closely attached parties. The psychological impact of the death penalty on immediate family members is of great concern. Holler (2018) noted that the debate which led to the amendments on the age of the death penalty only to include adults was challenged from a psychological perspective. His research and most other researchers delve into the sentenced victim’s intellectual capacity, leaving out the mental impacts on the affected parties. The issue the topic intends to address is the psychological impact that capital punishment has on the immediate family members of the victim.

Purpose statement.

The gap in research is the psychological impacts of the death penalty on the immediate family members in the state of Texas. To address this gap, the research aims to investigate how immediate families of victims faced with the death penalty cope with the situation and how the situation affects their psychological well-being. This includes answering research questions: How do families that have had one of their family members executed cope with the circumstance of pronunciation of the judgment and after execution? What is their psychological well-being before and after the execution of the victim?
