Please refer to the Turkey-Azerbaijan Pipeline Agreement for this coursework. You should assume that the Agreement is current and has not been modified. Please do not take into account any factual events relating to the Agreement in your answer. You should NOT comment on the TANAP project generally. You may assume that the pipeline is now operational.
a) Critically comment on the dispute prevention mechanisms provided for in the Agreement. Do you see any room for improvement? Please use relevant sources to support your answer. AND
b) A dispute has arisen as to whether Turkey had successfully acquired relevant private land to provide for the pipeline project. Discuss whether Azerbaijan may resort to the dispute resolution procedures under the Energy Charter Treaty. AND
c) If BOTA? decides to buy a volume of gas from Azerbaijan for export to company X in England, advise BOTA? as to whether they would be vulnerable to litigation in England if the gas turns out not to be of the right quality. BOTA? are a state owned oil and gas company, established in Turkey. X is established and domiciled in England.
