Internal Justification Statement

Competency
In this project, you will demonstrate your mastery of the following competency:

Explain how discretion is utilized in decision making within criminal justice professions
Scenario
You are a patrol officer on duty with your partner. At approximately 1:45 a.m., you observe a fast-moving vehicle run through a red stoplight. You attempt to stop the vehicle, which refuses to pull over but does turn on its hazard signal. Using light detection and ranging (lidar) technology, you determine the vehicle to be traveling in excess of the posted speed limit. After a brief two-mile traffic pursuit, the vehicle pulls into a hospital emergency room ambulance bay. The male driver exits the vehicle with his arms raised in the air and begins shouting at you and your partner. A female passenger then exits the vehicle, also with her arms raised. She yells that her water broke and that she is in active labor and needs to get into the hospital. What step do you take next? How do you address the situation?

Possible next steps:

Arrest the male driver for reckless driving, fleeing, and eluding, which means he will miss the birth of his child.
Issue a warning to the male driver and get medical personnel to address the female passenger.
Issue traffic citations to the male driver and get medical personnel to address the female passenger.
Escort the couple into the hospital and do nothing regarding traffic violations/pursuit.

Internal Justification Statement
You will be creating a written internal justification statement to submit to the chief of your department. You are a new patrol officer and are asked to provide information on how discretion could be used for this situation and other situations. Using the scenario, create a written statement (with all sections identified) that addresses all of the required elements:

Explain what it means to exercise discretion and the role it plays in the criminal justice field.
Describe the roles integrity, authority, discretionary power, and morality play in discretionary decision making. Answer the following questions in your description:
What is the relationship between integrity, authority, and discretionary power?
What is the difference between ethics and morals, and how does each affect discretionary decision making?
Summarize the actions taken in response to the provided discretionary dilemma. Answer the following questions in your summary:
What discretionary decision did you make for the provided scenario?
Why did you make the decision?
Explain how integrity, authority, discretionary power, and morality affected the decision you made. Answer the following questions in your explanation:
What role did integrity, authority, and discretionary power play in the decision you made?
How did ethics and morals influence your decision in this scenario?
Explain how decisions in law enforcement affect discretionary decisions made in courts and corrections. Answer the following questions in your explanation:
If you choose to summons or arrest the male driver, how might the court react once the circumstances are known?
What discretionary decisions may be made in court?
How could the decisions made in court potentially affect corrections?
What to Submit
To complete this project, you must submit the following:

Internal Justification Statement
Create a written statement justifying the discretionary decisions made in the scenario. This statement will be for internal use only and will be kept on file within your department. The statement should address the rubric criteria listed above: exercising discretion; integrity, authority, discretionary power, and morality in discretionary decision making; summary of actions; integrity, authority, discretionary power, and morality in the provided scenario; and decisions affecting other branches.

Submit your statement as a 2 page Word document with 12-point Times New Roman font, double spacing, and one-inch margins. Cite sources according to APA style.

Internal Justification Statement
Introduction
As a patrol officer, I am faced with various situations where exercising discretion is crucial in making decisions. Discretion refers to the authority and power given to criminal justice professionals to make choices based on their judgment and understanding of the circumstances. In the criminal justice field, discretion plays a vital role in ensuring fairness, efficiency, and effective outcomes. This internal justification statement aims to explain the concept of discretion, the role of integrity, authority, discretionary power, and morality in decision-making, and how these factors influenced my decision in the provided scenario.

Exercising Discretion in the Criminal Justice Field
Exercising discretion is an integral part of the criminal justice system. It allows professionals to adapt their responses to unique situations and consider various factors before making decisions. This flexibility is essential as it enables officers to prioritize public safety, promote justice, and prevent unnecessary harm. By utilizing discretion, criminal justice professionals can apply the law appropriately and respond to the specific needs of individuals involved.

Role of Integrity, Authority, Discretionary Power, and Morality
Integrity, Authority, and Discretionary Power
Integrity, authority, and discretionary power are closely intertwined in decision-making processes. Integrity refers to the adherence to moral and ethical principles, while authority refers to the legal power granted to officers. Discretionary power represents the range of choices available to criminal justice professionals when making decisions. These elements influence each other in decision-making as follows:

Integrity guides decision-makers to act in a manner consistent with ethical standards, ensuring fairness and impartiality.
Authority provides the legal framework within which officers can exercise discretion, ensuring their decisions are within the boundaries of the law.
Discretionary power allows officers to consider the circumstances, context, and individual factors when making decisions, enabling them to use their professional judgment effectively.
Ethics and Morals
Ethics and morals both play a significant role in discretionary decision-making. Ethics refers to a set of principles or standards that guide behavior in a specific profession or society. Morals, on the other hand, encompass personal beliefs and values that shape an individual’s understanding of right and wrong. In decision-making processes, ethics provide a framework for professional conduct, while morals influence personal perspectives and judgments.

Summary of Actions in the Provided Scenario
In the given scenario, my discretionary decision was to issue a warning to the male driver and ensure that medical personnel addressed the female passenger’s urgent medical needs. This choice was made based on several considerations:

The driver’s actions were reckless but not malicious or deliberate.
The female passenger was in active labor and required immediate medical attention.
The pursuit ended at a hospital emergency room ambulance bay, providing a suitable environment for medical assistance.
Influence of Integrity, Authority, Discretionary Power, and Morality in Decision-Making
Role of Integrity, Authority, and Discretionary Power
Integrity played a significant role in this decision as it guided me to act fairly and impartially. By considering the circumstances and prioritizing public safety while also acknowledging the urgent medical situation, I aimed to strike a balance between enforcing traffic laws and ensuring the well-being of both individuals involved. Authority provided the legal framework within which I could exercise discretion and make an informed decision that aligned with my responsibilities as a patrol officer.

Influence of Ethics and Morals
Ethics influenced my decision by ensuring that my actions were consistent with professional standards and guidelines. The ethical principle of prioritizing public safety guided me to address the reckless driving behavior while also considering the immediate medical needs of the pregnant woman. Morals played a role by shaping my personal perspective on compassion and empathy, leading me to prioritize the well-being of both individuals involved.

Decisions in Law Enforcement and Their Impact on Other Branches
Decisions made by law enforcement officers can significantly impact discretionary decisions made in courts and corrections. In this scenario:

If I had chosen to summons or arrest the male driver, the court would likely consider the circumstances once they are known. The court may take into account the urgency of the medical situation and evaluate whether the driver’s actions were intentionally reckless or a result of panic.
In court, discretionary decisions may be made based on factors such as previous driving records, intent, and the potential impact on public safety. The court may decide on appropriate penalties or alternative sentencing options.
Decisions made in court could potentially affect corrections by influencing sentencing outcomes. Depending on the court’s decision, corrections may be responsible for implementing appropriate measures such as probation or incarceration.

In conclusion, discretion is a vital component of decision-making within criminal justice professions. By exercising discretion, criminal justice professionals can consider various factors, adapt their responses to unique situations, and prioritize public safety while still addressing individual needs. Integrity, authority, discretionary power, ethics, and morals all play crucial roles in shaping these decisions. As demonstrated in the provided scenario, my decision was influenced by these factors, leading me to issue a warning to the male driver while ensuring immediate medical attention for the pregnant female passenger. These decisions can have significant impacts on subsequent discretionary decisions made in courts and corrections.
