4. Who do you think the article’s intended audience is? Is the article readable for everyone or does it appeal to only certain segments of the population?
5. Is the author proposing a new interpretation of the past (a different explanation for a historical event) or is it a confirmation of earlier interpretations? Could it be a little bit of both?

 

 

Probation risk will become too dependent on technology

Are there risks that probation will become too dependent on technology through such methods as supervision kiosks, for example, and thereby fail to devote sufficient human resources for supervision and services?
Are there risks that technical failures, such as erroneously believing that an electronical device is working properly, will lead to problems that increased human supervision might have prevented?

Evidence-based sentencing

Evidence-based sentencing reflects an effort to incorporate a rehabilitative focus into the design of criminal sanctions. Is this an appropriate job for judges? Do judges know enough about the causes of criminal behavior to accurately apply information from the EBS process to their attempts to tailor an appropriate sanction that will simultaneously punish and reduce the risk of reoffending?

The case of Coker v. Pershad

 

In the case of Coker v. Pershad, Terence Pershad, the driver of a tow truck for Five Star Auto Service, responded to a call to AAA North Jersey, Inc. for road assistance by the driver of a car involved in an accident. Pershad got into a fight with Nicholas Coker, a passenger in the car. Coker filed a suit in a New Jersey state court against Pershad, Five Star, and AAA. The court ruled that Pershad was an employee of Five Star, not AAA, and that Five Star was an independent contractor, and concluded that AAA was “not responsible for the alleged negligence of its independent contractor, defendant Five Star, in hiring Mr. Pershad.” Coker appealed.

A state intermediate appellate court affirmed. “It is clear AAA did not control the manner and means of Five Star’s work.”

Give and discuss the reasons that AAA would want to avoid liability for Coker’s injuries.

 

Wrongful convictions

Review and explain the factors that have been shown to sometimes lead to wrongful convictions. How does the recent U.S. Supreme Court ruling in Shinn v. Ramirez factor into this equation? Do you agree with the Courts 6-3 decision?

You have enough food and water to keep only four people alive for the several weeks you expect to be adrift until you float into a shipping lane and can be discovered and rescued. You will all parish if the five of you consume all the food and water. There is the suggestion that one of you should die so the other four can live. Would you volunteer to commit suicide? Would you vote to have one go overboard if you choose by straws? Would you vote to throw overboard the weakest and least healthy of the five? –If you were on a jury judging the behavior of four who did murder a fifth to stay alive, would you acquit them or convict them of murder? — Would your answer be different if the murdered victim were your son or daughter?
