Prosecutors are given great discretion on how to “charge out” a crime

Prosecutors are given great discretion on how to “charge out” a crime. One often used approach is to issue multiple counts in the charging document also referred to as to encourage a guilty pleas and avoid trial. Some would argue this puts an incredibly unfair burden on the defendant to accept a plea of reduced time rather than run the risk of a long prison term even when they are not guilty. Or is this simply using good legal skills by the government to bring speedy justice? What are a prosecutor’s ethical duties? What role might law enforcement play in this decision?

Intervention (Justice)

Whichever option you choose, your proposal should:
• Briefly summarize what the focal injustice is and why it is important to address it (1 paragraph max)
• Explain the goals and methodologies of your proposed intervention(s):
o What specific aspect of the injustice is this intervention designed to target?
o Why this intervention in particular? (Why do you believe it will be effective?)
o What kinds of resources would be needed for this intervention?
o Who is the target audience? Whose support will it be necessary to ensure?
• If relevant, you may also want to describe a specific group or organization you want to work with for one or all of your proposed interventions.
o Although these are individually-authored papers, justice is rarely accomplished alone. Most lasting social change is accomplished in

Classes of hate crime offenders

Describe the four classes of hate crime offenders typified by McDevitt and colleagues (2002) by giving an example of each.

5. Despite other countries taking a relatively tough stance on hate speech, American jurisprudence has leaned heavily on free speech as opposed to speech regulation resulting in protection of hate speech under the First Amendment. Imminent lawless action is a standard established in Brandenburg v. Ohio (1969) limiting freedom of speech when the speaker intends to incite a violation of the law that is both imminent and likely. Do you feel that this standard protects potential victims of hate speech and possible violence? Do you believe that the guarantee of freedom of speech is a sound or just public policy? Explain your reasoning.

Crime in America

Crime in America has become a normal part of everyday life. There have been ongoing discussions on crime control and possible policies that could slow down crime in America. However, when it comes to slowing down the willingness to commit crime, there are two theories that have had a significant impact on the reduction of crime. The two theories are Specific Deterrence and General Deterrence. Specific deterrence focuses on the individual, while general deterrence focuses on the general public. While each specific and general deterrence has a different focus, the overall purpose of these theories are preventing crime.

Using the knowledge that you have gained from this week’s reading assignments, Intellipath and MUSE assets, and other information provided, address the following questions in a 2-3 page paper:

Identify and discuss the similarities and differences between general deterrence and specific deterrence.
Using the resources and materials provided this week in class, discuss a criminal case that best explains each theory.
Provide your opinion on whether you believe these theories work at preventing future crimes.
